All content on bynacre.com, including texts, graphics, logos, site architecture, prompt system, and knowledge base, is the exclusive property of the publisher. Any reproduction without prior written authorization is prohibited.

The byNacre trademark and the Brand Voice Engine commercial name are commercial designations of the publisher. Any unauthorized use is prohibited.

5. Limitation of liability

byNacre is a strategic assistance tool. The recommendations produced by the Consultante are indicative and cannot substitute for professional advice. The publisher cannot be held responsible for decisions made on the basis of the tool's recommendations.

6. Applicable law

This legal notice is governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of French courts.

Terms of use

1. Service description

byNacre offers an artificial intelligence service specialized in luxury marketing, available by monthly subscription. The service includes:

  • The Consultante: an AI assistant trained on luxury market codes and strategies
  • Creation and management of Brand Voice Profiles (custom brand profiles)
  • Complementary features for content production, market intelligence and launch orchestration

byNacre is an assistance tool, not a professional advisory service.

2. Service access and account creation

Access to the Consultante requires creating an account and paying a subscription. By creating your account, you agree to provide accurate information, keep your credentials confidential, not share your access with third parties, and be at least 18 years of age.

3. Subscription and billing

The Consultante subscription is offered at the following rates:

  • Monthly: €490/month (or $549/month for clients billed in USD)
  • Annual: €390/month billed yearly (or $439/month for clients billed in USD)

Billing is handled by Stripe. Payments are charged automatically at each renewal. You may cancel your subscription at any time from your account, access remains active until the end of the current period.

In accordance with article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital services delivered immediately with your express consent at sign-up.

4. Usage quotas

The subscription is subject to a monthly token generation quota. Beyond the quota, the service continues with the tool's built-in knowledge. The quota renews at the start of each billing cycle.

5. Acceptable use

It is strictly prohibited to: attempt to circumvent security measures, use the service to produce illegal content, resell or sublicense access, or use unauthorized automated means.

6. Ownership of user content

You retain full rights to the content you provide (brand information, conversations, Brand Voice Profile). byNacre acquires no rights over your content.

7. Applicable law

These terms are governed by French law.

Privacy policy

byNacre places particular importance on the confidentiality of your brand data. Your conversations with the Consultante are not read, analyzed, or used for commercial purposes. Anthropic's Claude API does not use them to train its models. Your strategic information remains strictly confidential.

2. Data collected

Account data: email address, encrypted password (never stored in plain text). If you use Google sign-in, only your email and name are transmitted.

Billing data: collected and processed directly by Stripe. byNacre never has access to your full payment information.

Brand Voice Profile: information provided during onboarding is stored in our secure database and strictly necessary to operate the service.

Conversations: your exchanges with the Consultante are sent to Anthropic's Claude API to generate responses, and stored so that you can access your history.

Technical data: IP address (security), connection timestamps, usage counters.

3. Our cookie policy

byNacre uses no advertising cookies, no marketing trackers, and no third-party behavioral analytics tools.

The only cookies present are strictly necessary for the service to function:

  • Authentication session cookie (Supabase): keeps you signed in. Technically essential.
  • Payment security cookie (Stripe): used during transactions only, to prevent fraud.

No third-party cookies. No tracking pixels. No browsing data shared with advertisers.

4. Sub-processors

  • Anthropic (Claude API): processing of conversations to generate responses. Data is not used to train the models.
  • Supabase: database hosting.
  • Vercel: site and application hosting.
  • Stripe: payment processing (PCI DSS certified).
  • Voyage AI: embeddings for the byNacre knowledge base only (no personal data).

Transfers to third countries are made on the basis of the Standard Contractual Clauses of the European Commission.

5. Your rights (GDPR)

You have the rights of access, rectification, erasure, portability, objection, and restriction over your data. To exercise them: bynacre@proton.me

In case of an unsatisfactory response, you may file a complaint with the French data protection authority (CNIL): cnil.fr

6. Retention periods

  • Account data and Brand Voice Profile: duration of the subscription + 30 days
  • Billing data: 10 years (legal obligation)
  • Technical data: 90 days

7. Security

Encryption of data in transit (HTTPS/TLS), encryption of passwords, access control via Row-Level Security (RLS) on the database, isolation of data between users.

In the event of a data breach, notification within 72 hours (GDPR article 33).
